Anti-Discrimination Process

The Nysmith School is a diverse, inclusive community that celebrates and cherishes the unique backgrounds of all students, families, and staff.

Unkind comments, harassment, discrimination, or any conduct that undermines our shared values will not be tolerated. These behaviors may include verbal or nonverbal actions, gestures, drawings, or any other form of communication, whether intended or not.

Every member of our community has the responsibility to report conduct that violates these expectations.

Reporting

Reports may be made by anyone to:

  • Any teacher

  • Any administrator

  • Any staff member

  • The designated parent liaison (listed by the School)

Investigation Committee

If a report involves an allegation based on a protected characteristic, the School will convene a working committee consisting of:

  • The Upper or Lower School Director (depending on student ages)

    • Lower School: preschool–3rd

    • Upper School: 4th–8th

  • One or more school counselors

  • A parent liaison

Investigation Timeline

Upon receiving an allegation, the committee will investigate as quickly as possible—preferably the same day if the report is made during school hours.

Investigation Considerations

The committee will determine:

  • What was said or done

  • To whom the behavior was directed

  • Whether the allegation is substantiated, suspected, certain, or unclear

  • Whether the behavior was malicious, thoughtless, or otherwise

  • The student’s level of remorse and understanding

  • Any harm caused

  • Whether patterns of behavior exist

  • The likelihood of recurrence

  • Any additional relevant information

Outcome

At the conclusion of the investigation, the committee will submit a brief summary to the Head of School with recommended action.

The Head of School is responsible for reviewing, approving, or denying the recommendation.

Parents of involved students will be contacted and provided an update and additional information, if appropriate.

Within a reasonable time, a formal report will be submitted to the independent monitor attorney for evaluation.

No Retaliation

The School prohibits retaliation against any person who reports or assists in an investigation involving unkindness, harassment, disparagement, discrimination, or other policy violations.
